Volkswagen Environmental Mitigation Trust for State Beneficiaries

The Volkswagen Environmental Mitigation Trust for State Beneficiaries (Environmental Mitigation Trust) is part of settlement agreements with Volkswagen (VW) for their use of illegal defeat devices in certain 2.0-liter and 3.0-liter diesel vehicles designed to cheat emissions testing.  The use of illegal defeat devices resulted in tons of excess nitrogen oxides (NOx) in violation of federal vehicle pollution standards. The Environmental Mitigation Trust shall be used to reduce emissions of NOx emitted by offending vehicles per eligible mitigation actions (EMAs) prescribed in the Environmental Mitigation Trust.

The Virginia Department of Environmental Quality (DEQ) is the designated lead agency to act on the Commonwealth’s behalf in implementing Virginia’s $93,633,980 allocation of the Environmental Mitigation Trust. As required by the Environmental Mitigation Trust, DEQ developed a Beneficiary Mitigation Plan (the Plan) through an extensive public process. The Plan was finalized in August 2018, and submitted by DEQ to the Trustee, Wilmington Trust, N.A. The Plan describes the EMAs prescribed in the Environmental Mitigation Trust that can be funded from Virginia’s allocation of the Trust.  The overall goal of the Plan is to mitigate approximately 2,000 tons of excess NOx, emitted by approximately 16,000 offending vehicles sold in Virginia, through investments in a range of EMAs to reduce short-term and long-term NOx emissions.

Trust Allocation

To date, DEQ has obligated $91,668,675 (administrative expenditures included) of the $93,633,980 Environmental Mitigation Trust allocated to Virginia for the following EMAs implementation expenditures to reduce NOx and other harmful air pollutants:
