Update on the Hazardous Waste Generator Improvements Rule

The Virginia Waste Management Board will consider this rule at their meeting scheduled for January 8 2018 as part of the annual update to the Virginia Hazardous Waste Management Regulations. If the Board adopts the changes it will be published in the Virginia Register and will become effective at least 30 days after publication.

Updated Landfill Gas Guidance

DEQ's Division of Land Protection and Revitalization has released new guidance and submission instructions titled "Clarification of Landfill Gas Regulatory Requirements" These documents have been posted to Town Hall. This is just a reminder that although this new EPA regulation will be effective on the federal level on May 30,2017,it will not be effective in Virginia until the new requirements are adopted as part of the Virginia Hazardous Waste Regulations. Since Virginia is an authorized state, Virginia is required to adopt those provisions of the rule that are more stringent than the current RCRA regulations to maintain authorized status. Authorized states are not required to adopt provisions of the rule that are less stringent or no more stringent that the current hazardous waste regulations.
In Virginia, new EPA hazardous waste rules are typically adopted administratively by reference. Such regulatory changes must first be approved by the Virginia Waste Management Board and typically become effective 30 or more days after publication in the Virginia Register.
