Permitting & Compliance

Water Permitting

The Department of Environmental Quality, through the State Water Control Board, regulates water resources and water pollution in Virginia. Permitting for water protection involves the issuance of Virginia Pollutant Discharge Elimination System (VPDES) permits, Virginia Stormwater Management Program (VSMP) permits, and Virginia Pollution Abatement permits for discharges of pollutants to state waters; Virginia Water Protection permits for impacts to wetlands and streams related to development activities or surface water withdrawals; and ground water withdrawal permits for significant withdrawals from ground water in designated ground water management areas.

Water Permit Applications - Early Dispute Resolution

Persons or parties applying for a water permit from the DEQ may be notified of application deficiencies that will, in most cases, be necessary to resolve in order for the agency to issue the permit.  Where the applicant does not agree with deficiencies presented by the agency, the applicant may meet with appropriate DEQ staff to resolve the disagreement.  If after such informal discussions the disagreement between the applicant and agency remains unresolved, the applicant may use the Process for Early Dispute Resolution described in DEQ Agency Policy Statement No. 8-2005 and provided in § 10.1-1186.3 of the Code of Virginia and 9VAC25-15 as the next step to resolve the disagreement.

Water Compliance

The water compliance programs ensure that activities regulated by DEQ under a permit are in compliance with water protection requirements. Compliance activities include inspecting permitted facilities and reviewing required reports to ensure the owner is in compliance with permit conditions to protect water resources. Though minor corrective actions can be taken outside of formal enforcement, sometimes compliance activities result in formal enforcement actions to ensure that corrective actions are taken.

Electronic DMR Submissions (e-DMR)

The VPDES Electronic Reporting Rule (e-RR) became effective on July 26, 2017 to incorporate requirements of EPA's NPDES e-Reporting Rule.  DEQ's e-RR contain the compliance dates that require the electronic reporting of VPDES program information.  Please follow this link for more information about the e-DMR program.
