Public Notices

Consent orders from the State Water Control Board and the Waste Management Board are available for public comment before issuance of the final order.  DEQ issues public notices on these draft consent orders to ensure the opportunity for public comment before the order becomes final.  

What is a Consent Order?

A consent order is a negotiated order.  It is issued to an owner, operator or other responsible party for a violation to perform specific actions that will bring the entity into compliance with the relevant legal requirement.  Consent orders are developed cooperatively with the responsible party and entered into by mutual agreement.  The consent order may provide detail concerning the assessment and collection of civil charges for past violations.  DEQ, in conjunction with the state Air, Water and Waste Boards, issues a variety of enforcement orders to facilities to secure compliance with environmental laws and regulations.

What are Remedy Consent Orders and Administrative Agreements?

Remedy consent orders and administrative agreements are negotiated mechanisms that address remedial action at a certain property. It is issued to an owner, operator or other responsible party whereby that entity agrees to remediate a specific parcel of property. Remedy consent orders and administrative agreements are developed cooperatively with the party and entered into by mutual agreement. Remedy consent orders and administrative agreements are issued pursuant to the Waste Board's authority in Va. Code § 10.1-1402 and do not necessarily contain provisions for the assessment and collection of civil charges for past violations.
