Waste regulations - Chapter 90

In its 2004 session, the General Assembly authorized the collection of annual fees from solid waste management facilities (SWMFs). 2004 Acts cc 249, 324. The Virginia Waste Management Board approved final regulations assessing annual fees, 9 VAC 20-90, which became effective July 1, 2004. The regulations call for the payment of solid waste annual fees no later than October 1st of each year for activities in the preceding calendar year (CY), with certain exceptions.

Changes to Annual Fee Regulations in 2010

At the June 14, 2010 meeting, the Virginia Waste Management Board adopted amendments to the Annual Fee Regulations in 9VAC20-90 to implement provisions of budget item 354 of House Bill 30 (HB 30), as enacted by 2010 General Assembly. The revised annual fee schedule became effective on August 18, 2010 and affected annual fees required to be submitted by October 1, 2010.

Revised Annual Fees for 2011

The 2011 General Assembly passed SB1007 which revised the annual fees solid waste management facilities are required to pay. This will affect annual fees to be submitted by October 1, 2011 for activities conducted during calendar year 2010. No changes were made to permit action fees. The revised Solid Waste Management Permit Action Fees and Annual Fees Regulation 9VAC20-90 became effective on August 3, 2011.
