How to submit public comments for proposed water certifications for ACP and MVP

DEQ has posted information, a new factsheet and FAQs, that may help guide those who are submitting public comments on the proposed 401 Water Quality Certifications for the Atlantic Coast and Mountain Valley Pipelines. Copies of the proposed certifications and other documents are available at bit.do/DEQpipelines. Please note the public comment period ends on August 22.

SB 1398 requires assessment of coal ash impoundments closures in the Chesapeake Bay Watershed

Senate Bill 1398 (https://lis.virginia.gov/cgi-bin/legp604.exe?171+ful+CHAP0817+pdf) adopted by the 2017 General Assembly, requires every owner or operator of coal combustion residual (CCR) surface impoundments located in the Chesapeake Bay Watershed to conduct an assessment regarding the closure of the unit. These assessments are to be provided no later than December 1, 2018. The bill also requires that DEQ suspend, delay, or defer the issuance of solid waste permits regarding the closure of these surface impoundments until at least May 1, 2018. The bill goes into effect July 1, 2017.

Specifically, SB 1398 requires that the assessments be conducted for the CCR surface impoundments at: Bremo Power Station, Chesapeake Energy Center, Chesterfield Power Station, and Possum Point Power Station. The legislation also delays the solid waste permitting for closure of these surface impoundments. Although the bill does not go into effect until July 1, 2017, those previous publicly noticed draft solid waste permits for Possum Point and Chesapeake Energy Center are suspended and no other draft solid waste permits for closure of the four sites are proposed at this time. Consistent with SB 1398, no solid waste permits for closure of the CCR surface impoundments at these four sites will be issued until at least May 1, 2018, the date established in the bill.

Draft permit and public hearing regarding sludge sedimentation basins at Clover Power Station

On May 8, 2017 DEQ published notification of the proposed Solid Waste Permit 622 to be issued to Virginia Electric and Power Company and Old Dominion Electric Cooperative for two sludge sedimentation basins at the Clover Power Station. This notice seeks public comment and announces a public hearing on June 8, 2017 at 7:00 PM at the Halifax County Administration Building, 1030 Cowford Road, Halifax, VA.

DEQ staff will answer questions during an informational session at 6:00 PM the night of the public hearing. Questions and comments made during this information session will not be part of the official public comment record.

The proposed solid waste permit is to address two sludge sedimentation basins that manage wastewater and solids including flue gas desulfurization, is a type of Coal Combustion Residual (CCR). These basins are approximately 4 acres in size and manage the waste water and solids on a temporary basis. Wastewater is reused in the Station's process and the solids are removed to the on-site landfill. At the end of their service life, the basins will be closed by removal. The proposed permit includes requirements of EPA Final Rule on CCR.

Public hearing and public info meeting regarding closure of Possum Point coal ash impoundments

On January 13, 2017 DEQ published notification of the proposed Solid Waste Permit 617 to be issued to the Dominion Virginia Power Possum Point Power Station. This notice seeks public comment and announces a public hearing on February 16, 2017 at 7:00 PM at the Potomac Senior High School located at 3401 Panther Pride Drive, Dumfries, VA 22026. An informational briefing will be held prior to the public hearing from 6:00 PM to 6:45 PM on the evening of the public hearing. Questions and comments made during this information briefing will not be part of the official public comment record. An inclement weather date of February 23, 2017 at the same location and time has been reserved if needed.

The public comment period extends from January 13 to March 10, 2017.

On January 26, 2017 DEQ staff will answer questions during an information session at 7:00 PM at the Potomac Senior High School located at 3401 Panther Pride Drive, Dumfries, VA 22026. An inclement weather date of February 2, 2017 at the same location and time has been reserved if needed. Questions and comments made during this information session will not be part of the official public comment record.

The proposed solid waste permit is to address closure of the coal combustion residuals (CCR) surface impoundments at the Possum Point Power Station and also includes post-closure care, groundwater monitoring, and surface water monitoring requirements.
