ACL Updates

DEQ has published the newly updated Default 10-6 Alternate Concentration Limits (ACL) Table, effective January 2, 2018. The letter, updated Table 6.1 and the list of changes can be found on the DEQ website at:

The new, updated ACL table issued as “draft” reflects the updates in the EPA Regional Screening Level (RSL) Table through the end of 2017.

Updated Landfill Gas Guidance

DEQ's Division of Land Protection and Revitalization has released new guidance and submission instructions titled "Clarification of Landfill Gas Regulatory Requirements" These documents have been posted to Town Hall. Hazardous Waste Generator Improvements Rule – Not Effective in Virginia on May 30, 2017

This is just a reminder that although this new EPA regulation will be effective on the federal level on May 30,2017,it will not be effective in Virginia until the new requirements are adopted as part of the Virginia Hazardous Waste Regulations. Since Virginia is an authorized state, Virginia is required to adopt those provisions of the rule that are more stringent than the current RCRA regulations to maintain authorized status. Authorized states are not required to adopt provisions of the rule that are less stringent or no more stringent that the current hazardous waste regulations.
In Virginia, new EPA hazardous waste rules are typically adopted administratively by reference. Such regulatory changes must first be approved by the Virginia Waste Management Board and typically become effective 30 or more days after publication in the Virginia Register.

Draft Landfill Guidance Request for Comments

The Department is seeking to improve its existing guidance on landfill gas monitoring and remediation. It includes revisions to the existing Submission Instruction No. 13 and Solid Waste Inspection Manual attachments.
