  1. Major State and Federal Permits and Approvals Applicable to Facility Development

    • Army Corps of Engineers (Section 404, Clean Water Act, for dredging and filling of waters of the United States, including associated wetlands; Section 10, Rivers and Harbors Act, for obstructions to navigable waterways);
    • State Water Control Board - Virginia Water Protection Permit (Water Quality Certification, Section 401, Clean Water Act);
    • Marine Resources Commission (encroachments in, on, or over State-owned bottomlands or tidal wetlands (Code of Virginia � 62.1-1 thru 62.1-13); sand dune impacts (� 62.1-l3.21 thru 62.1-13.28);
    • Plan approvals by the Department of Conservation and Recreation, Division of Soil and Water Conservation for Erosion and Sediment Control Plans (Code of Virginia �10.1-560) and/or Stormwater Management Plans (� 10.1-603);
    • Discharge, no-discharge, and other permits administered by the State Water Control Board (Section 402 of the Clean Water Act and Code of Virginia � 62.1-44.2 thru � 62.1-44.34:23);
    • New source, Prevention of Significant Deterioration, and other permits administered by the Department of Air Pollution Control (Code of Virginia � 10.1-1300 et seq);
    • Hazardous material handling, treatment, storage, disposal, transportation permits administered by the DEQ-Waste Management Division (Code of Virginia � 10.1-1400 et seq);
    • Solid waste disposal facility permits administered by the DEQ-Waste Management Division (Code of Virginia � 10.1-1400 et seq).
    • For projects located in Tidewater Virginia, the activities must be consistent with the requirements of the local ordinance developed pursuant to the Chesapeake Bay Preservation Act. Site plans must be submitted to the Chesapeake Bay Local Assistance Department for review and approval (Code of Virginia � 10.1-2114).
    • State agencies, upon receipt of a request from a locality, shall transmit a copy of the construction and site plans to the locality for comments. Also, DEQ shall distribute a copy of the Environmental Impact Review to the locality (Code of Virginia � 15.2-2202).
