State-specific Regulatory Programs

Occasionally, the State Air Pollution Control Board, either on its own or at the behest of the General Assembly, will promulgate a regulation that applies only in Virginia.

The following programs are authorized under state law only:

• Air toxics - For existing sources, see Article 3 of 9 VAC 5 Chapter 40. For new sources, see Article 3 of 9 VAC 5 Chapter 50.
• Odor - For existing sources, see Article 2 of 9 VAC 5 Chapter 40. For new sources see Article 2 of 9 VAC 5 Chapter 50.
• Medical Waste Incinerators - For new sources, see Article 6 of 9 VAC 5 Chapter 50.
• Mediation and alternative dispute resolution - See 9 VAC5 Chapter 210.
