Secondary Containment, Delivery Prohibition & Operator Training

The federal Energy Policy Act of 2005 required states accepting federal funding for their UST programs to make certain changes to those programs. Some of these changes required a revision to Virginia’s UST regulation 9VAC25-580. Specifically, these changes impose new requirements in three areas:
  (1) require secondary containment for certain tanks;
  (2) prohibit delivery to certain non-compliant tanks; and
  (3) require training for certain classes of UST operators.

Secondary Containment

Secondary containment (e.g., double-walled tanks and pipe) is required for any new and replaced UST systems installed within 1,000 feet of a public water supply or potable well—which in effect means virtually all new or replaced USTs must have secondary containment.

Each new motor fuel dispenser system must have under-dispenser containment. If an existing motor fuel dispenser system is replaced, under-dispenser containment is required if any piping component is modified (e.g., flexible piping connectors). These requirements do not apply to repairs meant to restore an underground tank, pipe, or dispenser to operating condition. If more than 50% of the length of a piping run is replaced, then the entire piping run must be secondarily contained.

UST systems (tank and/or piping) installed after September 15, 2010 are required to perform monthly interstitial monitoring for release detection. The interstitial space between the inner and outer walls of the tank and piping must be monitored monthly. A monthly record of the interstitial monitoring must be kept for 12 months and provided to the UST inspector upon inspection.

All new UST system (tank and pipe) equipment vendors and installers must be alert to this change—no new or replaced single-walled tanks or single-walled piping will meet UST regulation requirements after September 15, 2010. NOTE: During the transition period as installations occur around the September 15 effective date, single-walled tank/pipe work already under signed contract may proceed as designed and contracted.

Operator Training

An operator training program requires UST operators (Class A, B, & C) to be trained by August 8, 2012. As UST operator training is required nationally, many vendors provide testing and training that will properly educate UST operators about how to maintain compliant tank systems and how to recognize and respond to problems associated with leaking USTs. DEQ UST inspectors will ask for proof of completion of operator training after the August 8, 2012 deadline as a part of their routine UST inspections.

The UST owner should document their Class A, B, and C operators and ensure all operators obtain a training certificate from an approved training program to document successful training completion.

All Class A or Class B training programs should obtain approval through the Virginia Department of Environmental Quality. A training approval form is currently under development and will be placed on the website as soon as it is finalized.

Virginia DEQ will recognize successful completion of Class A and Class B operator training that is consistent with the Federal EPA requirements (40 CFR Part 280) which is recognized by another state and approved by EPA as meeting operator training grant guidelines.

Class C training programs will be verified by the compliance inspector at the time of the inspection, and thus, do not need to submit information for approval.

Delivery Prohibition (REDTAG)

The delivery prohibition (“red tag”) program provides added incentive for UST owner/operators to maintain compliant tank systems. Red tags are placed on the fill(s) of noncompliant tanks and prevent delivery of fuel. Non-compliant UST owners are notified through an Informal Fact Finding meeting with DEQ prior to any red tagging of their tanks.
